Terms of Use

Agreement

This portal is operated by Davis Investigation Services ("Davis", "we") to run applicant background screening. By signing in, or by using an application link sent to you, you agree to these terms. How your information is handled is described in our Privacy Policy.

Who may use the portal

Signed-in access is for Davis staff and for users authorized by a client company. Applicant links are for the person they were issued to, and work once. If you were not given access, you may not use the portal.

Your account is yours alone

Keep your password and two-factor device to yourself. You are responsible for everything done under your sign-in, and every action is recorded in the audit trail. Tell Davis immediately if you believe your account has been compromised — access can be revoked instantly.

Acceptable use

You agree not to:

  • access information you are not authorized to see, or attempt to get around the portal's access controls;
  • use applicant information for anything other than the lawful screening purpose it was collected for;
  • share sign-in credentials, forward secure links to people they weren't issued to, or republish reports outside the portal's share-link system;
  • probe, scan, scrape, or disrupt the portal, or introduce malicious code.

Client companies are separately responsible for their own legal obligations around consumer reports, including notices required before and after any adverse decision based on a report.

The portal is provided as-is

We work hard to keep the portal secure and available, but it is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and uninterrupted availability.

Limitation of liability

To the fullest extent permitted by law, Davis and its service providers are not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the portal, and total liability for any claim relating to the portal is limited to the amount the claiming party paid Davis for the services giving rise to the claim during the twelve months before the claim arose.

Suspension and termination

Davis may suspend or end access — for a user, a company, or an applicant link — at any time, including for violations of these terms. Records already collected remain governed by the Privacy Policy and the applicable retention schedule.

Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts of Texas.

Changes

If these terms change, this page changes with them, with a new effective date at the top. Continued use after a change is acceptance of the updated terms.
